General terms and conditions for the client and the persons in the client system

These general terms and conditions are applicable to the use of the QIT Online application by Clients and persons in the Client System.

 

  • The Client is the natural person whose data is processed by the Caretaker.

  • Persons in the Client System are all the natural persons who are part of the treatment and who will provide input for the treatment on a periodical basis. Data concerning them will also be processed.

 

1. In general: processing of personal data

 

The personal data the Client and the persons in the Client System provide to the Caretaker, through the QIT online application, will be processed in order to execute the agreement between the Client and the Caretaker concerning the therapy.

 

The processing of personal data of persons in the Client System is based on their explicit consent.

 

2. Explicit consent to the processing of data concerning health

 

The processing of personal data necessarily entails the processing of data concerning the Client’s health. By checking the appropriate box at the end of these general terms and conditions, the Client explicitly consents to the processing of this data concerning his/her health by the Caretaker. This consent is a necessary condition for the processing of the data in the QIT Online application. Absence of this consent results in the inability to process this data.

 

Persons in the Client System always need to explicitly consent to the processing of their data by the Caretaker. They can do so as well by checking the appropriate box at the end of these general terms and conditions. This consent is a necessary condition for the processing of the data in the QIT Online application. Absence of this consent results in the inability to process this data.

 

3. Processing of the data by the Organisation

 

Administrative data will be processed by the Organisation the Caretaker is affiliated with, for the purpose of coordinating activities. The Organisations may use this data for drawing up general reports as well, after the data has been anonymised.

 

4. QIT bvba as processor

 

The data is uploaded to the digital QIT Online application, developed by QIT bvba. By choosing to use this application, the Caretaker, together with the Organisation (for the administrative data), has become the responsible processor for the data concerned. QIT bvba’s role is limited to the role of processor, which entails that QIT bvba is responsible for the technical implementation of the data processing, in accordance with the Caretaker’s instructions.

 

5. Security & responsibility

 

The QIT Online application is protected in an appropriate way. Access is guaranteed by an encrypted https-connection and personalised login. QIT Online is hosted by Digital Ocean, a ISO 27001 certified hosting provider that complies with the ISMS requirements (Information Security Management System) and offers extensive guaranties with regards to quality, safety and privacy protection.

 

6. Sharing Client data and data concerning persons in the Client Systems between Caretakers

 

Sharing data concerning the Clients and persons in the Client System with other Caretakers is possible under the following conditions:

 

  • The other Caretaker(s) has (have) an account with the QIT Online application.

  • The sharing of data is necessary for the client’s trajectory.

  • Sharing of data only allows the receiving party to read the data. Any alterations or adaptations of the data is not possible.

  • The Client and the persons in the Client System shall be informed on the sharing of their data, and will have the possibility to object to the sharing of their data.

 

7. Transferring Client data and data concerning persons in the Client Systems between Caretakers

 

Transferring data concerning the Clients and persons in the Client System to other Caretakers is possible under the following conditions:

 

  • The other Caretaker(s) has (have) an account with the QIT Online application.

  • The transferring of data is necessary for the client’s trajectory.

  • Transferring of the data entails transferring the full management of the client file to another Caretaker.

  • The Client and the persons in the Client System must agree to the transfer of their data. In order to do so, they must explicitly agree to the processing of their data by the new Caretaker.

 

8. Exercise of the rights with regards to the Caretaker and/or the Organisation

 

The Client and the persons in the Client System can exercise his/her/their rights under the General Data Protection Regulation with the Caretaker and/or the Organisation, depending on the specific data in question.


 

O       I explicitly consent to the fact that data concerning my health will be processed on the QIT Online application.
